ORDER
The petitioner, who participated in the recruitment to the post of Health Inspector Grade II, has filed this writ petition to 2/7
issue a writ of declaration to declare that the examination conducted by the third respondent on 07.12.2025 for the post of Health Inspector Grade II based on the notification dated 27.10.2025 as illegal.
2.The learned counsel appearing for the petitioner, by referring on the orders of the Principal Seat in WP.No.1309 of 2026 dated 20.01.2026, submits that the Principal Seat has taken cognizance of the complaint made in the process of the examination conducted by the third respondent in some centres and has passed an order directing the respondents to verify the CCTV footages of the examination centres pointed out by the petitioner therein and to pass orders on merits and in accordance with law. The enquiry was not conducted as directed by this Court and therefore, this Court while entertaining the present writ petition on 27.01.2026, was inclined to grant an order of interim stay. However, the learned Additional Advocate General appearing for the first and second respondents submitted that 3/7
they will not issue any appointment order till 29.01.2026 and requested time to file their reply.
3.Counter affidavit has now been filed. The learned Additional Advocate General has also placed the FIR registered in Cr.No.10 of 2026 on the file of Vallathirakottai Police Station, Pudukkottai District dated 03.02.2026 and submits that based on the complaint of the Administrative Officer of the Medical Services Recruitment Board, Chennai, a criminal case has been registered as against the invigilators, four candidates, who appeared in the centre at Pudukottai for the offence under Section 318(4) BNS. He further submits that the petitioner before the Principal Seat in WP.No.1309 of 2026 was also issued with a reply on 07.02.2026 and a copy of the enquiry proceedings is also enclosed in the typed set of papers along with FIR. 4.In view of the response shown by the respondents to the earlier order passed in WP.No.1309 of 2026 dated 20.01.2026, this 4/7
Court is vacating the interim order dated 27.01.2026. However, it is made clear that the results of the recruitment shall be subject to the outcome of the investigation in Cr.No.10 of 2026. The Government shall also ensure a fair investigation in Cr.No.10 of 2026, which is registered on the file of the Vallathirakottai Police Station, Pudukkottai District, by referring the matter to the CBCID. The investigation agency shall also find out the manner in which the examinations were conducted in other centres during the course of investigation. The respondents are directed to preserve CCTV footages in all centres and hand over the same to the investigation agency.
