ORDER

This petition is filed to direct the first respondent police to give necessary police protection to the life and limb of the petitioner.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor.

3. The learned counsel appearing for the petitioner submitted that the petitioner despite having obtained an order of interim injunction in a suit in O.S.No.196 of 2017 which he has laid against the second respondent, faces threat to his life, limb, liberty and right to property.

4. The learned Additional Public Prosecutor submitted that the petitioner is arrayed as accused in Crime No.13 of 2018 for the offences under Sections 120 (b), 420, 465, 468, 471 and 447 IPC.

5. To this, the learned counsel appearing for the petitioner submitted that the petitioner has preferred a petition to quash the FIR filed against him and the same is pending.

6. For the present, if the petitioner continues to face any threat perception to his life, limb, liberty and right to property, he is directed to prefer a fresh complaint / representation to the first respondent, whereupon the first respondent shall cause such necessary enquiry on the complaint given by the petitioner and take such appropriate decision as may be necessary to protect the life, https://hcservices.ecourts.gov.in/hcservices/

limb, liberty and right to the property of the petitioner. It is made clear that this Court does not order granting of police protection 24 x 7 and the first respondent is left to decide on the basis of the objective assessment of the threat perception of the petitioner from time to time.

7. With the above direction, this Criminal Original Petition is disposed of.
