Prayer: Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the respondent Nos.2 to 4 to instruct the respondent Nos.5 to 8 not to interfere in the civil dispute regarding the petitioner's properties in Survey No.198/8, Pothampatti Village, Usilampatti Taluk, Madurai District and further direct the respondent Nos.5 to 8 not to harass the petitioner and petitioner's family members in accordance with law. O R D E R
This writ petition has been filed directing the respondents Nos.2 to 4 to instruct the respondent Nos.5 to 8 not to interfere in the civil dispute regarding the petitioner's properties in Survey No.198/8, Pothampatti Village, Usilampatti Taluk, Madurai District and further direct the respondent Nos.5 to 8 not to harass the petitioner and petitioner's family members in accordance with law.
2. The learned Additional Public Prosecutor appearing for the respondents 1 to 5 would submit that due to the dispute between the petitioner and the respondents 6 to 9, the fifth respondent registered the FIR as against the petitioner as well as the respondents 6 to 9 in Cr.No.15 & 16 of 2022 and both the cases are pending for investigation.
3. In view of the above submission, this Court directs the fifth respondent not to interfere with any of the civil dispute pending between the petitioner and the respondents 6 to 9 herein with regard to property comprised in Survey No.198/8, Pothampatti Village, Usilampatti Taluk, Madurai District, except Cr.Nos.15 & 16 of 2022. It is made clear that if any statutory authority to seek police protection while surveying the subject land, the fifth respondent shall consider the same on merits and in accordance with law.
4. With the above direction, the writ petition stands disposed of. No order as to costs.
