The petitioner/Accused, who was arrested and remanded to judicial custody on 03.07.2023 for the alleged offences under Sections 448, 294(b), 324, 506(ii) of IPC and Section 4 of TNPHW Act @ Sections 448, 294(b), 324, 506(ii), 109, 307 IPC in Crime No.127 of 2023 on the file of the respondent Police, seek bail.

2. The case of the prosecution is that due to previous enmity between the petitioner and the defacto complainant's sister, the petitioner and other accused trespassed into the victim's house and attacked her with aruval with intent to murder her, scolded her using filthy language and also threatened her with dire consequences. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner did not commit in any such allegations levelled in the F.I.R and he is no way connected with the alleged occurrence. Hence, he prays to grant bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that totally 15 previous cases are pending against the petitioner, among which, three cases are registered under Section 302 IPC, 2 cases are registered under Section 307 IPC and three cases are registered under Section 399 IPC. Hence, he strongly opposed to grant bail to the petitioner.

5. Heard. Perused the materials available on record including the First Information Report.

6. Considering the facts and circumstances of this case and also considering the previous antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
