ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent. 2.The petitioner is shown as an Accused in C.C No.219 of 2014 on the file of the learned Additional Mahila Court, Madurai for the offences under Sections 498A, 406 and 506(ii) IPC and Section 4 of Dowry Prohibition Act in Crime No.22 of 2010 on the file of the Inspector of Police, Madurai South, Madurai City. 3.The petitioner's non bailable warrant has been pending for more than two and half years. The petitioner filed this criminal original petition for anticipatory bail. The next hearing date is 05.03.2020.
4.The learned counsel for the petitioner states that the petitioner shall pay a sum of Rs.10,000/- as cost for her abscondence for the last two and half years. The cost shall be paid to the bank account of the Superintendent, Government https://hcservices.ecourts.gov.in/hcservices/ 1/2

If he is unable to appear, his counsel will represent him and file an application under Section 317 of Cr.P.C. On account of the petitioner's absence, trial will not be stalled. If this undertaking is breached, the order now passed will stand vacated automatically and the petitioner will be remanded to custody. 6.Recording the said undertaking given by the petitioner through his counsel, the petitioner is directed to appear before the Court below on 05.03.2020 and apply for recall of warrant. On such application being filed, the Court below shall recall the warrant at the end of the day. Non Bailable Warrant shall be kept in abeyance till then.
7.The Criminal Original petition stands disposed of on these terms.
