PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, to call for the records pertaining to the summons issued by the sixth respondent dated Nil and quash the same as illegal. For Petitioners : Mr.T.A.Ebenezer For Respondents : Mr.M.Sakthi Kumar Government Advocate(Crl.Side) O RDER This petition has been filed seeking to call for the records pertaining to the summons issued by the sixth respondent dated Nil and quash the same as illegal.
2. On 17.10.2023, the respondent police namely the Inspector of Police, Pudhukottai Police Station, appeared before this Court and the then Additional Public Prosecutor, who was appearing for the respondent police, on instructions had submitted before this Court that further action has been dropped in this matter. Recording the above said submission, that petition was disposed of as unnecessary on 09.10.2015. But, again the present summon has been issued to the petitioner calling him for enquiry in the very same Crime number. Therefore, seeking quashment of the same, this present petition has been filed. 2/5
3. After hearing both side counsels, this Court called for the report from the Special Court for Idol Theft Cases, Srivilliputhur, with regard to the stage of Crime No.71 of 2010.
4. Today, a report is received from the concerned Court, it shows that this Court in Crl.O.P(MD).Nos.8690 and 12060 of 2017 dated 21.07.2017 has ordered to transfer the case in Crime No.71 of 2010 to the Additional Chief Judicial Magistrate, Kumbakonam. Therefore, closure report filed by the Investigating Officer was not accepted by the Special Court for Idol Theft Cases, Srivilliputhur. Now, the investigation was undertaken by the Inspector of Police, Idol Wing, Tirunelveli and the investigation is pending.
5. Since the investigation was transferred, the petitioner is directed to appear before the concerned Investigating Officer and co-operate to complete the process of investigation. During the course of investigation, if any trouble arises, the petitioner is at liberty to workout his remedy through the appropriate proceedings. Therefore, There is no quashment of summon at this stage.
