Prayer : Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to call for the records relating to the First 1/5

Information Report in Crime No.10 of 2024 on the file of the 2nd respondent police and to quash the same as illegal as against the petitioners/accused no. 1 to 7.

ORDER

This petition has been filed by the petitioners/Accused No.1 to 7 to call for the records pertaining to the First Information Report in Crime No. 10 of 2024 dated 16.08.2024 on the file of the first respondent police, for the offences under Sections 120B, 420, 465, 468 and 471 of I.P.C and quash the same.

2. When the matter was taken up for hearing, the learned counsels on both sides represented that the matter has been amicably settled between the parties and to that effect, they have entered into a compromise and the same was filed before this Court.

3. The defacto-complainant and the petitioners are present and this Court enquired about the terms of compromise. The defacto-complainant 2/5

represented that they entered into a compromise and she has no objection to quash the F.I.R. A compromise memo signed by the parties and their respective counsel is also filed before this Court.

4. The learned Government Advocate (Criminal Side) appearing for the respondents no.1 and 2 would submit that already the 3rd petitioner has approached this Court in Crl.O.P(MD) No.16013 of 2024 dated 06.11.2024 for transfer the case from this investigating agency to another investigating agency and the same was allowed. Now the case is pending before the Director General of Police (DGP) office for passing appropriate order.

5. This Court has perused the terms of the compromise memo.

6. Since the matter has been settled between the parties, the order passed by this Court dated 06.11.2024 to transfer the investigating agency is no way affect the rights of the parties to compromise. Considering the nature of the offences and the parties have also entered into a compromise, it is appropriate to allow this petition.

7. Recording the said compromise memo, this criminal original petition is allowed and the First Information Report in Crime No.10 of 2024 3/5

dated 16.08.2024 on the file of the respondent police is quashed as against the petitioners / Accused No.1 to 7.
