P RAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 to survey the petitioner's land with the help of fifth respondent herein and mark necessary boundaries for petitioner's property comprised in S.F.No.88/1, measuring 0.18 cents as per the patta No.945 in the limits and jurisdiction of Bikshandarkoil village which lies in Manachanallur Taluk, For Petitioner : Mr.B.Karthikeyan For R1 to R3 : Mr.B.Saravanan Additional Government Pleader For R4 & R5 : Mr.Vaikkam Karunanithi Government Advocate (Crl.side)

ORDER

The petitioner seeks issuance of writ of mandamus to direct the second respondent to survey the lands of the petitioner and to direct the respondents 4 & 5 to provide police protection at the time of measurement.

2. Considering the limited scope of the prayer, by consent of both parties, the Writ Petition is taken up for final disposal at the 2/5

admission stage itself.

3. I have heard the learned counsel appearing on either side and perused the materials placed before this Court.

4. The grievance of the petitioner is that though an application was made as early as on 08.10.2024 remitting the requisite fee seeking for survey and demarcate the petitioner's land, no action has been taken by the second respondent. It is set out in the affidavit that the second respondent has informed the petitioner that there was resistance from adjacent land owners and therefore, the respondents are unable to survey the land. Therefore, the petitioner also seek for police protection.

5. Considering the limited scope of the prayer sought for in this writ petition, I am inclined to entertain the writ petition. Accordingly, the writ petition is allowed and the writ of mandamus is issued to the second and third respondents to conduct survey and demarcate the petitioner's land with the help of the jurisdictional police, 3/5
