ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 498(A), 294(b), 323 and 506(ii) of the Indian Penal Code and Sections 3, 4 and 6 of Dowry Prohibition Act in Crime No.2 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner is the husband of the defacto complainant and the petitioner along with other accused demanded more dowry and threatened her with dire consequences.
3. Earlier, this Court referred the matter before the Mediation and Conciliation Centre and the Mediation could not succeed. Hence, the matter is referred back to the Court.
4. The learned counsel for the petitioner submitted that the defacto complainant did not appear before the Mediation Centre except the first hearing and he would further submit that charge-sheet has already been filed.
5. Heard the learned Government Advocate (Criminal Side).
6. Considering the facts and circumstances of the case and also considering the fact that the investigation has been completed and the charge sheet has been filed, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Eraniel and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with https://hcservices.ecourts.gov.in/hcservices/
two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the concerned Court regularly in all future hearings without fail. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
7.
