Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st respondent to take appropriate action on the petitioner's representation dated 06.02.2021 and direct the 2nd respondent not to conduct Katta Panchayat in the guise of enquiry while pending the insolvency proceedings before the concern court. ORDER

The Writ Petition has been filed in the nature of Mandamus, seeking a direction to the first respondent to take appropriate action on the petitioner's representation, dated 06.02.2021 and to direct the second respondent not to conduct Katta Panchayat in the guise of enquiry while pending the insolvency proceedings before the Court concerned.

2.The learned Additional Public Prosecutor appearing for the respondents stated that based on the representation of the petitioner, the respondent police conducted an enquiry and the same is pending.

3.In view of the above, the first respondent is directed to conduct the enquiry after giving opportunity of hearing the https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD).No.2897 of 2021 petitioner and the counter party if any and pass orders on merits and in accordance of law, within a period of four weeks from the date of receipt of a copy of the order.

4.With the above direction, this Writ Petition stands disposed of. No costs.
