Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned proceedings in Na.Ka.No. 2947/E2/2021/dated 27.12.2021 by the second respondent and quash the same as illegal and consequently direct the respondents 1 and 2 to permit the petitioner to sale or other encumbrance in the above said property comprised in Survey No.521/1B to an extent of 1 Acre and 40 Cents, share of 70 cents situated at Thathanur Village, Puliyamankombai Post, Aundipatti Taluk, Theni District till the disposal of the suit in O.S.No. 191/2020, pending before the learned Additional District sessions and Fast Track Court, Theni District.

2. Even though the petitioner has challenged the impugned order dated 27.12.2021 passed by the first respondent before this Court, it is 2/4

stated that he had also parallelly filed appeal before the first respondent. The petitioner can very well work out his rights before the first respondent.

3. Granting liberty to the petitioner to pursue his remedy before the first respondent in the pending appeal, this writ petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
