ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 123 of BNS 2023 and Section 6(b), 24(1) of COTPA Act 2003, in Crime No.6 of 2026 on the file of the respondent police, seeks anticipatory bail. The case of the prosecution is that the petitioner along with other accused persons were found to be in illegal possession of 46 kgs of Cool lip and 297 kgs of Ganesh 701 Tobacco products./ Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioners had already been granted interim anticipatory bail by this Court dated 28.01.2026 and he has co-operated with the investigation. He further submitted that the petitioner has appeared before this Court and filed an affidavit of undertaking, stating that he will refrain from selling or transporting the banned tobacco products, specifically Cool Lip. He further submitted that the petitioner is ready and willing to abide by any 2/5

conditions that may be imposed by this Court. Hence, he seeks anticipatory bail for the petitioner.

4. The learned Government Advocate (Crl.Side) submitted that the petitioner has complied with the conditions imposed by this Court dated 28.01.2026.

5. Considering the facts and circumstances of the case and since the petitioner has complied with the conditions imposed in the interim anticipatory bail regularly, the interim anticipatory bail already granted by this Court dated 28.01.2026, is made absolute on the following conditions.

[a] the petitioner shall report before the respondent police as and when required for interrogation.

[b]the petitioner shall not tamper with the evidence or witness either during investigation or trial. [c]the petitioner shall not abscond either during 3/5

investigation or trial.

[d]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[e] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
