ORDER
This Criminal Original Petition has been filed to direct the learned District Munsif cum Judicial Magistrate, Peraiyur to refund the amount a sum of Rs.50,000/- which was deposited by the petitioner on 06.01.2014, in crime No.235 of 2013 as per the order of this Hon'ble Court made in Crl.O.P(MD) No.21992 of 2013 dated 11.12.2013.
2. The learned counsel for the petitioner would submit that the petitioner was granted anticipatory bail by this Court with a direction to deposit Rs.50,000/- to the credit in Crime No.235 of 2013 on the file of the learned Judicial Magistrate, Peraiyur. Pursuant to the same the petitioner has also deposited the same vide receipt No.117001 dated 06.01.2014. Subsequently the petitioner and the defacto complainant compromised the matter and joint compromise memo has also been filed based on which case in Crime No. 235 of 2013 has been closed. After quashing of the First Information Report, the petitioner has approached the lower court for return of money deposited in Crime No.235 of 2013 and the lower Court advised the petitioner to approach this Court.
3. In view of the same, the petitioner is directed to file a appropriate petition before the concerned Court and on filing such petition the trial court is directed to consider the same and pass https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.2196 of 2020 appropriate orders within a period of one week from the date of receipt of a copy of this order.
4.With the above direction, this Criminal Original Petition is closed.
