Seeking family pension of his father, the petitioner has approached this Court.
2.The case of the petitioner is that his father, namely, Nagarajan, who served in the Sub Treasury Office, Kamuthi died on 29.01.2010. There was a dispute among the petitioner's family and the first wife of the deceased in getting the terminal benefits and other pension benefits. Subsequently, the petitioner's father's first wife, namely, Sangamirtham died on 20.08.2016 and their son Suganthan also died on 16.01.2018. The petitioner and his sister are the legal heirs of the deceased Nagarajan through his second wife, namely, Maala. The grievance of the petitioner is that though he has submitted all the relevant documents, the family pension has not been provided to him.

3.The learned counsel appearing for the petitioner submits that by referring to the proceedings of the Accountant General, dated 30.06.2025 submits that the Accountant General has accepted the case of this petitioner that he is eligible for family pension and also directed to furnish the following details:- i. Family Pension proposals of Vijayaregunath along with Income Certificate from Revenue authorities and a Proof of his date of birth.
ii. Date of Marriage of Maala with Nagarajan with proof. iii.PPO number allotted by the Accountant General Office, if any iv. Reason for submitting the proposal after 15 years. According to the petitioner, he has submitted the required documents as directed by the Accountant General in his proceedings, dated 30.05.2025 to the Treasury Officer, District Treasury, Ramanathapuram District/the third respondent, however, the third respondent has not forwarded the same to the Accountant General till date.

4. Mr.G.Karthick, learned Standing Counsel takes notice for the respondents 1 & 2. Mr.G.V.Vairam Santhosh, learned Additional Government Pleader takes notice for the third respondent and submit that this petitioner is the deceased's second wife's son and therefore, his request has not been considered for the family pension.
5.Admittedly, this petitioner is the son of the deceased employee, Nagarajan, through his second wife. His first wife and his son through the first wife are no more as on date. The petitioner is aged about 23 years. The petitioner has obtained a legal heir certificate from the Revenue authorities that he, his mother and his sister are the only legal heirs of the deceased Nagarajan. The certificate has also been issued pursuant to the order of the Civil Court.

In view of the above, this Court directs the third respondent to scrutinize the documents, which are placed by the petitioner and shall take a decision either to forward or not, within a period of four weeks from the date of receipt of a copy of this order. The petitioner is also expected to produce all the documents and to co-operate for the enquiry, if any. Accordingly, this writ petition stands disposed of. No costs.
