RESPONDENT / RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to STAY all further proceedings in M.C.No.50 of 2016 on the file of the Distict Family Court, Tirunelveli,pending disposal of the Crl.R.C.(MD)No.171 of 2017 and thus render justice. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.J.ASHOK Advocate for the petitioner the court made the following order:- This Criminal Miscellaneous Petition is filed to stay all further proceedings in M.C.No.50 of 2016 on the file of the District Family Court, Tirunelveli, Pending disposal of Crl.RC(MD)No.171 of 2017.

2. The learned Counsel for the petitioner is present. The respondent appeared in person.

3. The learned Counsel for the petitioner submitted that the petitioner has deposited a sum of Rs.15,000/- before the Family Court, Tirunelveli as per order of this Court dated 23.02.2017. The learned Counsel for the petitioner further submitted that he has no objection to withdraw the deposited amount by the respondent herein from the Family Court.

4. The respondent, who appeared in person submitted that a legal counsel may be appointed for contesting this case before this Court.

5. The learned Counsel for the petitioner filed a memo by enclosing the copy of proof of deposit in respect of depositing a sum of Rs.15,000/- on 07.03.2017. Hence, the condition is complied with.

6. Interim Stay already granted is made absolute. This Petition is allowed. The respondent is directed to withdraw the deposited amount by filing proper application before Family Court.

7. Registry is directed to engage a legal aid counsel for the respondent to contest this case and post the Crl.RC.on 08.06.2017. sd/- 18/04/2017 / TRUE COPY / Sub-Assistant Registrar (C.S.) Madurai Bench of Madras High Court, Madurai - 625 023.
