RESPONDENT/ RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to exempt the petitioners from surrendering before the Trial Court in Connection with the sentence imposed upon the petitioners in CrlA.29/2020 on the file of the learned I Additional District and Sessions Judge(PCR),Trichy by confirming the sentence imposed upon the petitioners in S.C.No.107 of 2019 on the file of the Learned Chief Judicial Magistrate, Trichy pending disposal of the above Criminal revision petition.

Prayer in CRL RC(MD). 124/ 2022 :

To call for the records relating to the judgment dated 4/9/2021 in CA No.29/2020 on the file of the Learned First Additional District and Sessions Judge(PCR),Trichy thereby confirming the judgement of the Learned Chief Judicial Magistrate, Trichy dated 29/1/2020 in S.C.No.107 of 2019 and convicted and sentenced the 1st accused to undergo 3 years rigorous imprisonment and Rs.1000/- fine for each offence under sections 326 and 506(ii) of the Indian Penal Code in default of the amount and to undergo 3 years simple imprisonment and sentenced the 2nd accused to undergo one years rigorous imprisonment and Rs.1000/- fine for offence under section 324 of the Indian Penal Code in default of the amount to undergo 3 months simple imprisonment and set aside the same and acquit the petitioners/accused.

CRL MP(MD) No.2202 of 2022 and of MRS.ASHA, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- Since both the petitioners surrendered before the Trial Court on 15.02.2022, and they were remanded to judicial custody and they were confined at Thuraiyur Sub Jail and Gandhi Market Women's Prison, Trichy respectively, this Criminal Miscellaneous Petition is dismissed.
