ORDER
Seeking to transfer the investigation in Crime No.54 of 2025 on the file of the second respondent to the third respondent for conducting fair and impartial investigation, this criminal original petition is filed. 2.The learned counsel for the petitioner submitted that the petitioner is the defacto complainant, on whose instance, Crime No.54 of 2025 was registered by the second respondent police for the offences under Sections 322, 324, 318, 335, 336(3) and 351 of BNS, 2023, with respect to the efforts taken by the accused persons, who are none other than Doctors and Advocates and who have already grabbed the petitioner's property comprised in S.Nos.64/4 and 64/5 situated at 2/6
Thiruporur Village, Chengalpattu District. In this regard, there is no progress in the investigation and hence, this petition. 3.The learned Government Advocate (crl.side), on instructions, submitted that only after obtaining details from the Sub Registry, Chengalpattu, they could proceed.
4.Heard either side and carefully perused the materials available on record.
5.Considering the fact that the victim /defacto complainant is a senior citizen of age 76, who is already bedridden, it is the considered opinion of this Court that the second respondent police should gear up the investigation and conclude the same within a period of four weeks from the date of receipt of copy of this order. It is also directed that the second respondent Police should appraise the progress of the investigation from time to time i.e.., every Friday to the first respondent/ Commissioner of Police, Madurai City and the first 3/6
respondent is directed to monitor the ongoing investigation undertaken by the second respondent police. It is also brought to the notice of this Court that on 24.11.2025 itself, all the applications made by the accused persons to avail anticipatory bail has been dismissed by the order of this Court. Despite the same, the second respondent police did not take any steps to arrest the accused persons. In this regard this Court hereby directs the second respondent police to take necessary action forthwith in accordance with law.
6.With the above directions, this Criminal Original Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. 03.02.2026 NCC : Yes / No Index : Yes / No Rmk 4/6
