ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police, for the offence punishable under Section 379 IPC r/w. 21(1) of Mines and Minerals (Development & Regulation) Act, 1957, in Crime No.731 of 2021 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused had illegally transported 1/4 unit of sand in a bullock cart.

3. This is the second anticipatory bail petition. The earlier anticipatory bail petition was dismissed by this Court by order dated 23.09.2021 on the ground that the petitioner is having four previous cases.

4. Considering the antecedent of the petitioner and since there is no change in circumstance, after the dismissal of earlier petition, this Court is not inclined to grant anticipatory bail to the petitioner.
