This Criminal Original Petition has been filed to set aside the order passed in C.C.No.254 of 2012 on the file of the learned Judicial Magistrate No.II, Nagercoil, under Section 317(2) Cr.P.C. and Rule 17 Cr.R.P. dated 20.08.2013.
2.When the matter was taken up for hearing, the learned Government Advocate (crl.side) appearing for the respondents would submit that the trial Court is posted the matter for arguments on 04.10.2018.
3.It is seen from the records that no ground is raised by the petitioners to quash the criminal proceedings against them. The grounds raised in the petition have to be gone into in a full fledged trial. Moreover, as submitted by the learned Government https://hcservices.ecourts.gov.in/hcservices/
Advocate (Crl side, in this case, trial Court is posted the matter on 04.10.2018 for arguments. Therefore, this Court is of the view that this Criminal Original Petition is liable to be dismissed. 4.Accordingly, the prayer sought for in this petition cannot be considered by this Court and the same stands dismissed.
