ORDER
This Criminal Original Petition is filed to direct the District court (Special Court for SC/ST (POA) Act), Ramanathapuram, to accept the surrender of the petitioner and consider the bail application on merits on the date of surrender in Cr. No. 137/2025 on the file of the 2nd respondent police.
2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.
3. The case of the prosecution is that when the defacto complainant and his friends went to the cultural program at Chinnandi Valasai, the petitioner and other accused persons were alleged to have waylaid the complainant, assaulted him with hands, abused him with caste name and also threatened him with dire consequences. Based on these allegations, an FIR in Crime No.137 of 2025 has been registered against the 2/4
petitioner on the file of the second respondent police for the offences under Sections 189(2), 296(b), 115(2) of BNSS and Sections 3(1)(r), 3(1) (s), 3(2)(va) of SC / ST (POA) Amendment Act, 2015.
4. Heard the learned counsel on either side and carefully perused the materials available on record.
5. Considering the limited scope of the relief sought for, this Court hereby direct the learned District court (Special Court for SC/ST (POA) Act), Ramanathapuram, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No. 137 of 2025 on the file of the 2nd respondent police.
