PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the 2nd respondent to produce the body of the detenue namely Subbulaxmi W/o.Paramasivam aged 33 years, Muthuvarshini D/o.Paramasivam, aged 4, and Balasurjith S/o.Paramasivam, aged 2, from the illegal custody of the 3rd respondents before this Court, and set them at liberty. ORDER

This petition has been filed seeking direction to direct the 2nd respondent to produce the body of the detenue namely Subbulaxmi W/o.Paramasivam aged 33 years, Muthuvarshini D/o.Paramasivam, aged 4, and Balasurjith S/o.Paramasivam, aged 2, from the illegal custody of the 3rd respondent before this Court and set them at liberty.

2. When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit based on the complaint given by the petitioner, a case in Crime No. 04 of 2020 was registered under the caption 'Woman Missing, Boy Missing and Girl Missing'. The second respondent traced the alleged detenue, boy and girl and produced before the learned Judicial Magistrate, Nanguneri. The learned Magistrate conducted enquiry, and during enquiry the alleged detenue Subbulakshmi had informed that she had decided to live with her parents along with her children and the petitioner was also aware of that and based on which, enquiry was closed.
