ORDER

Seeking direction to the 2nd respondent to provide necessary police protection to conduct survey in the petitioner's property on the basis of her representation dated 14.01.2026, this criminal original petition is filed.

The learned counsel for the petitioner submitted that the property comprised in Iyan Punja Resurvey No.91/2A to an extent of 38 cents situated at Ayyanarkulam Village, Usilampatti Taluk, Madurai District belong to the petitioner by the strength of partition deed bearing Document No.4283 of 2012, dated 06.11.2012. The petitioner had submitted a survey application on 22.12.2025 to the Tahsildar and Land Surveyor and necessary survey fee has also been paid. However, when the Tahsildar had fixed a date and issued notice to conduct survey on 27.12.2025, the respondents 3 to 6 had come to the petitioner's property 2/6

with henchman and had obstructed the Tahsildar from conducting the survey. Hence, this petition .

3. The learned Government Advocate(Crl.Side) submitted that the representation was sent by the petitioner only through registered post. Further, the petitioner was directed to appear before the respondent police on 19.01.2026 with supporting documents. However, the petitioner had not appeared.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

In this regard, the petitioner is advised to approach the 2nd respondent police forthwith with all necessary title documents pertaining to the land comprised in Iyan Punja Resurvey No.91/2A to an extent of 38 cents situated at Ayyanarkulam Village, Usilampatti Taluk, Madurai District and seek necessary protection by making an application in person. On receipt of the same, the 2nd respondent police 3/6

is directed to proceed in accordance with the law. The 2nd respondent Police is directed to issue notice under Section 164 BNSS to the petitioner as well as the respondents 3 to 6 and conduct necessary enquiry and thereafter, if the petitioner's title is established, proceed to afford proper protection to conduct the survey, on payment of necessary fees in terms of G.O(Ms)No.139, Home (Pol-VIII) Department, dated 04.03.2019.

6. With the above directions, this Criminal Original Petition stands disposed of.
