Respondents PRAYER :-Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus thereby direct the respondents 1, 2, 4 and 5 to enquire into allegations of corrupt practices and other illegalities committed by the respondents in the tender process held on 07.10.2025 with reference to tender notice No. 33/2025-26/HDO and connected tender process held on 07.10.2025 take appropriate action for causing loss to the Government exchequer by considering the petitioners representation dated 11.10.2025.

ORDER

This writ petition has been filed for a mandamus to direct the respondents 1, 2, 4 and 5 to enquire into allegations of corrupt practices and other illegalities committed by the respondents in the tender process held on 07.10.2025 with reference to tender notice No. 33/2025-26/HDO 2/6

and connected tender process held on 07.10.2025 take appropriate action for causing loss to the Government exchequer by considering the petitioner's representation dated 11.10.2025.

2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents. By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.

3. The learned counsel for the petitioner would submit that the petitioner is a Class I Contractor. He has given a representation to the official respondents to conduct enquiry with regard to the corrupt practice by the 7th respondent and their officials. However, since the said representation was not considered so far, the petitioner is before this Court with this writ petition.

4. The learned Government Advocate for the respondents would submit that since the petitioner was neither granted any contract nor any work order, in order to take revenge against the respondents, the 3/6

petitioner has preferred a complaint and has also filed the present writ petition.

5. I have considered the rival submissions and perused the materials available on record.

6. The petitioner is the Class I Contractor. He was not issued with any contract by the respondents. When he lost the contract, it appears that in order to take revenge against the private respondents,such representation was made alleging that the respondents involved in corrupt practice without there being any supportive documents and documentary evidence to substantiate their case. Though it is averred that there are documents available, it has not been produced. Therefore, this Court is not inclined to issue any mandamus as sought for by the petitioner. Accordingly, the writ petition stands dismissed. No costs. 17.02.2026 NCC : Yes/No Index : Yes/No RR 4/6
