ORDER : The Court Made the following order :- The petitioners, who is arrayed as accused Nos.1 and 3 in Crime No.653 of 2015 on the file of the respondent police, was arrested on 16.09.2015 for the alleged offences punishable under Sections 4(1) (aaa) r/w. 4(1)-A and Transport of TNP Act and hence, seeks bail.
2. According to the prosecution that when the de-facto complainant was in vehicle check up, the accused were found transporting 36 bottles of liquor (each contains 100 ml.), 90 bottles of liquor (each contains 500 ml.), 192 bottles of liquor (each contains 180 ml.), 96 bottles of liquor (each contains 500 ml.) and 192 bottles of liquor (each contains 500 ml).
3. The learned counsel for the petitioners submitted that the petitioners are the drivers and they are nothing to do with the alleged offence.
4. The learned Government Advocate (Crl.side) submitted that the accused 1 and 2 have been detained under Act 14 of 1982 and the second petitioner/A3 has no bad antecedents.
5. Considering the facts, this Court is inclined to grant bail to the second petitioner/A3 with certain conditions. In view of the submissions made by the learned Government Advocate (Crl.side), this petition is dismissed against the first Petitioner/A1. Accordingly, the second petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two https://hcservices.ecourts.gov.in/hcservices/
sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Trichy and on further condition that the second petitioner shall appear before the respondent police daily at 10.00 a.m. until further orders.
