ORDER

This petition has been filed to direct the respondent to cooperate with the enquiry in Maintenance Case in M.C.No.47 of 2017 on the file of the learned Chief Judicial Magistrate, Ramanthapuram, without fail in each and every hearings and consequently further direct the concerned Jurisdictional Magistrate to expedite the trial as early as possible to dispose of the above petition within the period prescribed by this Court.

2. Heard the learned counsel appearing for the petitioners.

3. The learned counsel for the petitioner submitted that the respondent in M.C.No.47 of 2017 is not cooperating for proper conduct of the trial, as a result of which, the petitioners are forced to live inpenury.

4. Considering the facts and circumstances of the case, the learned Chief Judicial Magistrate, Ramanthapuram, is directed to dispose of the case in M.C.No.47 of 2017 within a period of three months from the date of receipt of a copy of this order.

5. The learned counsel appearing for the petitioner submits that the first petitioner is physically challenged and her personal appearance may have to dispense with. He also added that the second petitioner is a minor.

6. In view of the above, the personal appearance of both the petitioners before the trial Court is dispensed with, unless the same is required by the trial Court. Accordingly, this criminal original petition is disposed of.
