PRAYER :- For Bail in Crime No.151 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 21.01.2023 for the offences punishable under Sections 4(1)(a), 4(1-A) of TNP Act in Crime No.151 of 2023 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner was found in illegal possession of 50 number of Tasmac brandy bottles (each containing 180ml), hence the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. He would further submit that the petitioner is in judicial custody from 21.01.2023, hence he seeks bail. https://www.mhc.tn.gov.in/judis 1/2

4. The learned Additional Public Prosecutor appearing for the respondent would submit that petitioner was found in illegal possession of 50 number of Tasmac brandy bottles (each containing 180ml). He would further submit that the petitioner is having 10 previous cases against him, hence he objected to grant bail to the petitioner.

5. Heard. Perused the materials available on record including the First Information Report.

6. Taking into consideration of the facts and circumstances of the case and also the submission made by the learned Additional Public Prosecutor this Court is not inclined to grant bail to the petitioner.

7. Hence the Criminal Original Petition stands dismissed for the present.
