ORDER

The petitioner Cotton Mill has filed this writ petition seeking for the issuance of Writ of Mandamus to the first respondent to refund a sum of Rs.4,67,116/- together with interest from the ESI Corporation.

2.When this writ petition is taken up for hearing, the learned counsel for the respondent ESI Corporation admits that the petitioner Mill is having two units and one unit is functioning in uncovered area, however, a sum of Rs.4,67,116/- has erroneously been paid by the petitioner Management for the Mill functioning 2/5

in uncovered area. On the filing of this writ petition, the amount has been worked out and returned to the petitioner Management in the month of November 2022. The proceedings of the Deputy Director is also placed before this Court to that effect. 3.The learned counsel appearing for the petitioner Management, after verification, fairly concedes with the submission made by the learned counsel for the respondent ESI Corporation.

4.Recording the above submissions, this writ petition is closed. No costs.
