Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the first respondent to renew the petitioner's passport (K9000665) application in File No.MD2073840948521 dated 27.12.2021 within the time limit stipulated by this Court.

*********** This Writ Petition has been filed for a Mandamus seeking for a direction to the first respondent to renew the passport based on the petitioner's application dated 27.12.2021.

2.The petitioner seeks for renewal of his passport under the aforementioned application. The first respondent has not renewed the passport on the ground that a charge sheet has been filed in C.C.No.300 of 2021, which is pending on the file of the Judicial Magistrate I, Nagercoil against the petitioner. 3.It is settled law that once charge sheet is filed, the petitioner will have to approach the concerned Magistrate Court seeking permission to get a passport. Learned Counsel for the petitioner is also agreeable to the same.

W.P.[MD]No.2372 of 2022 4.This Writ Petition is disposed of, by directing the petitioner to approach the Judicial Magistrate I, Nagercoil, seeking permission for the petitioner to renew his passport. The said Court on receipt of an application from the petitioner shall pass final orders on merits and in accordance with law within a period of four [4] weeks from the date of receipt of the application from the petitioner seeking permission.
