Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the third respondent to conduct an enquiry with regard to issuance of possession certificate issued in favour of the 5th respondent by the 4th respondent in respect of S.No. 731/5 to an extent of 0.14.00 Ares of Aralvaimozhi North Village, Thovalai Taluk, Kanyakumari District on the basis of the petitioners representation dated 09.12.2024.

O R D E R

This writ petition has been filed seeking a direction to the third respondent to conduct an enquiry with regard to the issuance of a possession certificate in favour of the fifth respondent by the fourth respondent in respect of the property comprised in S.No.731/5, to an extent of 0.14.00 ares, situated at Aralvaimozhi North Village, Thovalai Taluk, Kanyakumari District, based on the petitioner's representation dated 09.12.2024.

2. According to the petitioner, the fifth respondent, with an intention to grab the petitioner's land, in collusion with the fourth 2/5

respondent, obtained a possession certificate in respect of the petitioner's property. Aggrieved by the same, the petitioner submitted a detailed representation on 09.12.2024 to the official respondents seeking an enquiry into the issuance of the said possession certificate. However, the said representation has not been considered till date. Hence, the present writ petition.

3. The learned Government Advocate appearing for respondent Nos.1 to 4 would submit that the representation of the petitioner dated 09.12.2024 would be considered in accordance with law.

In view of the same, without expressing any opinion on the merits of the matter, this Court directs the third respondent to consider the representation of the petitioner dated 09.12.2024 and pass orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
