... RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition imposed in Crl. O. P. (MD) No. 856/2021 by order dated 22.01.2021, Permitting the Petitioners to execute surety bonds before the Judicial Magistrate, Valliyur, Tirunelveli District, instead of the Judicial Magistrate, Eraniel, Kanyakumari District.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.C.T.PERUMAL, Advocate for the petitioners and of Mr.M.V.CHANDRASEKARAN, Government Advocate(Crl. Side) on behalf of the Respondent, the Court made the following order:- Though the anticipatory bail was granted to the petitioners on 22.01.2021 directing the petitioners to execute the sureties before the learned Judicial Magistrate, Eraniel, Kanyakumari District, the learned counsel for the petitioner submitted the Eraniel Bar Association has issued a notice dated 15.01.2021 requesting the members of the Local Bar Association not to appear in Crime No.17 of 2021, since our member of Advocate Mr.S.Jayathu is the defacto complainant.

CRL MP(MD) No.1139 of 2021 2.In view of the same, the petitioner filed a modification petition to execute sureties before the learned Judicial Magistrate, Valliyur, Tirunelveli District or nearby judicial Magistrate Court out side of the District instead of learned Judicial Magistrate Eraniel, Kanyakumari District.

3.It is seen from the order in Crl.O.P(MD) No.856 of 2021, dated 22.01.2021 that the petitioners are given an option either to execute the sureties before the learned Judicial Magistrate, Erenial or before the Inspector of Police, Earniel Police Station, Kanyakumari District.

4.In view of the Bar Association resolution, this Court directs the petitioners to execute the surety bonds before the Inspector of Police, Eraniel Police Station, Kanyakumari District. Further two weeks time is extended to execute the sureties from the date of receipt of a copy of this order. All other conditions in the said order shall remain unaltered.
