PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to issue an order of appointment for any suitable post on compassionate ground to the petitioner within a stipulated time fixed by this Court. The instant Writ Petition has been filed by the son of a Cook, who was employed in the Adi Dravidar Welfare Students Hostel, seeking a Mandamus to provide compassionate appointment.

2. From the records it could be seen that the petitioner's father passed away on 02.06.2013 and an application was made on 07.10.2014 by the petitioner seeking compassionate appointment. The said application was forwarded by the fourth respondent to the third respondent. The third respondent has also forwarded the same to the second respondent. The second respondent was of the view that the petitioner having passed in SSLC examination, is qualified to be appointed as Junior Assistant. However, so far, orders have not been passed.

3. The learned Additional Government Pleader appearing for the respondents herein pointed out that the petitioner is ranked at serial No.11 in the seniority list maintained by the Virudhunagar Department for providing compassionate appointment. As and when the petitioner reaches seniority, his name would be considered for the eligible post.

4. Considering the above said facts, the respondents 2 and 3 are directed to consider the application of the writ petitioner for compassionate appointment as an when the petitioner reaches seniority and pass orders in accordance with law.

5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
