ORDER : The Court Made the following order :- The petitioner, who is arrayed as A26 apprehends arrest at the hands of the respondent police, in connection with a case in C.C.No.8 of 2015 on the file of the Special Court for TNPID Act Cases, Madurai for the alleged offence punishable under Sections 406, 420 and 120(b) of I.P.C., and Section 4 of TANPID Act, 1997 in Crime No.2 of 2013 on the file of the respondent police and hence, seeks anticipatory bail.

2.The learned counsel for the petitioner would submit that the petitioner was not aware of the registration of the case against her and she was also not arrested pending investigation. It is further submitted that the petitioner was added as an accused only in the charge sheet and her name was not mentioned in the FIR and that the respondent has already completed the investigation and laid a charge sheet, which was taken on file in C.C.No.8 of 2015 and that she is ready to appear before the trial Court and co-operate for completion of the trial.

3.The learned Government Advocate (Crl.side) would vehemently contend that the accused have swindled about Rs.11 crores of the money belonging the general public, so they are not entitled for any indulgence of this Court.

4.However, considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

5.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on her appearance before the Special Court for TNPID Act Cases, Madurai and on her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judge concerned and on further condition that the petitioner shall appear before the trial Court for all hearing dates without fail, except on those days by filing a petition under Section 317 of Cr.P.C, by assigning valid reasons. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6.The petitioner shall appear before the concerned Judge within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
