Amarnath : Respondents PRAYER : Petition is filed under Section 482 of the Criminal Procedure Code praying to direct the first respondent to instruct the second respondent to give police protection to the petitioner's life and limb through the representation dated 24.04.2019 pending before the first and second respondents.

ORDER

This Criminal Original Petition has been filed seeking police protection.

2. The grievance of the petitioner is that her husband, by name Selvaraj borrowed a housing loan from the third respondent by mortgaging his property. Even though he has repaid a part of the loan amount, now, for the remaining amount due, the third respondent https://hcservices.ecourts.gov.in/hcservices/

is said to have threatened the petitioner and her husband to pay the balance loan amount and thereby, harassing them. In the above circumstances, the present petition has been filed seeking police protection.

3. Admittedly, the petitioner's husband borrowed a loan from the third respondent and some amount is due to the third respondent. It is a civil dispute between the petitioner and the third respondent, for which, the police cannot be directed to give protection to the petitioner. If at all the third respondent is using any illegal method to recover the amount, it is always open to the petitioner to approach the concerned police by filing necessary complaint. Instead of that, the petitioner cannot seek for police protection and hence, the relief sought for by the petitioner cannot be granted.

4. Accordingly, this Criminal Original Petition is dismissed.
