ORDER

The petitioner is a driver having badge licence. He has applied before the respondent for renewal of licence. Since the same has not been considered, he has filed this writ petition for a Mandamus, directing the respondent to issue badge license to him, by considering his application dated 11.05.2023.

Mr.A.Baskaran, learned Additional Government Pleader, who takes notice for the respondent, submits that the petitioner is involved in a criminal case in Crime No.436 of 2023 on the file of the Alanganallur Police Station for the offences under Sections 279 and 304A IPC. Therefore, based on the police verification report, the respondent has issued a show cause notice to the petitioner on 01.01.2024 calling upon him to offer his explanation with regard to the stage of the criminal case pending against him within a period of ten days. The petitioner, without giving any response to the show cause notice, has approached this Court for a Mandamus directing the 2/5

respondent to consider his application dated 11.05.2023. The learned Additional Government Pleader further submits that if the petitioner co-operates for the enquiry, they will consider his application within a reasonable time.

It appears that based on police verification report, the respondent has issued a show cause notice dated 01.01.2024 to the petitioner calling upon him to offer his explanation on his involvement in the Criminal case. However, the petitioner has not responded to the show cause notice issued by the respondent.

4. In view of the same, this writ petition is disposed of with the following directions:

"(i) The petitioner shall appear before the respondent on 20.02.2024 at 3.00 p.m. with all necessary documents;

(ii) The respondent shall process the petitioner's application bearing No.1714806223 in accordance with law and take a decision on or before 27.02.2024. 3/5

(iii) The decision taken by the respondent shall be communicated to the writ petitioner under due acknowledgment within a period of one week from the date of decision."
