O R D E R
[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the first respondent in NO.RO/TRY/570/2025-CA dated 08.01.2026 and direct the first respondent to grant 21 days ordinary leave without police escort to the petitioner's son namely Siva, S/o.Murugesan @ Kandhan aged about 35 years, Life Convict Prisoner PID No.161935 confined at Central Prison, Trichy.

It is the case of the petitioner that her son was convicted by the learned Additional District and Sessions Judge/Presiding Officer[Special Court for EC and NDPS Act Cases) Mahila Court, Pudukottai in S.C. No.165 of 2017 on 23.04.2019 and sentenced to undergo life imprisonment for the offence under Section 304(1)r/w.149 of IPC. Aggrieved over the same, the convict has also filed an appeal before this Court in Crl.A(MD) No.212 of 2019 and the same was confirmed by this Court on 02.08.2022. The petitioner submitted an application seeking ordinary leave for a period of 21 days. After considering the
request made by the petitioner, the first respondent granted ordinary leave to the petitioner's son with escort. The petitioner being a poor person, could not afford the cost for escorts.
3. In view of the above, the condition imposed in the order dated 08.01.2026 directing the convict to go on ordinary leave with escort is modified and he shall go on ordinary leave without escort. However, the convict is directed to comply with the usual conditions imposed by the jail authorities and he should also report before the fourth respondent police daily at 05.30 p.m. He shall duly comply with the conditions and return to the prison on expiry of the leave period.
4. Accordingly, the order of the first respondent dated 08.01.2026 is quashed in sofar as the ordering escort alone and the Writ Petition is disposed of.
