This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first to fourth respondents to consider the petitioner's representation dated 08.01.2026 and to remove the name of the fifth respondent and include the names of the legal heirs of the petitioner's husband, namely D. Abiragam, S/o. Duraisamy Nadar, in all the revenue records in respect of the land comprised in Survey No.105/8, situated at Chithumoondradaippu Village, Kariapatti Taluk, Virudhunagar District.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to Page No. 2 of 6
the fifth respondent, as no adverse orders are proposed to be passed against her.
3. The grievance of the petitioner is that the petitioner's husband purchased two plots carved out of a portion of the property comprised in Survey No.48/1. The petitioner's husband died in the year 2020, leaving behind six legal heirs, including the petitioner. Subsequently, Survey No. 48/1 was renumbered as Survey No.105 and the plots were subdivided. Accordingly, the petitioner's properties were assigned Survey Nos.105/8 and 105/9.
4. In respect of the land comprised in Survey No.105/9, the petitioner's husband's name has been properly entered in all the revenue records. However, in respect of Survey No.105/8, the name of the fifth respondent, who is the adjacent landowner, has been wrongly entered.
5. A representation dated 13.08.2019 was make seeking rectification of the said error. Since the same was not considered, the petitioner's son filed a Writ Petition in W.P.(MD) No.22023 of 2019. This Hon'ble Court, by an order dated 18.10.2019, directed the authorities to Page No. 3 of 6
conduct an enquiry after giving sufficient opportunity to all parties concerned.
6. During the enquiry, the mistake was identified. However, the authorities requested the petitioner to submit a fresh application. Accordingly, a fresh representation dated 08.01.2026 was submitted. However, no action has been taken on the same. Hence, the petitioner has been constrained to file the present Writ Petition.
7. The learned Special Government Pleader appearing for the first to fourth respondents, on instructions, would submit that the petitioner's representation dated 08.01.2026 would be considered and appropriate orders would be passed by the third respondent within a period of twelve weeks.
8. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to consider the petitioner's representation dated 08.01.2026 and pass appropriate orders on its merits and in accordance with law within a period of twelve weeks from the date of Page No. 4 of 6
receipt of a copy of this order. The representation shall be disposed of after conducting an enquiry. The third respondent is also directed to provide a reasonable opportunity of hearing to the petitioner, the fifth respondent and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
