Prayer: This Criminal Original Petition filed under Section 482 Cr.P.C. to direct the respondent Police to take necessary steps to recover the amount a sum of Rs.11,00,000/- and jewels from the Accused in the case in Crime No.9 of 2020 within the stipulated period with this Court.

ORDER

This Criminal Original Petition has been filed to direct the respondent police to take necessary steps to recover the amount, a sum of Rs.11,00,000/- and jewels from the accused in the case in Crime No.9 of 2020 within the stipulated period fixed by this Court.

2. The learned Government Advocate appearing for the respondent submitted that the respondent police completed the investigation and filed final report as 'Mistake of Fact' on 30.09.2020. Thereafter, the petitioner was also served referred charge sheet notice on 31.10.2020.

3. Therefore, the prayer sought for in this Criminal Original Petition cannot be granted. This Criminal Original Petition is dismissed. However, the petitioner is at liberty to file a protest petition against the referred charge sheet before the concerned Judicial Magistrate in manner known to law, if so advised.
