Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences under Sections 354(c), 294(b), 323, 506(i) of I.P.C r/w Section 4 of Women Harassment Act, 2002 and Section 66(E) and 67(A) of Information Technology Act, 2008, in Crime No.8 of 2019, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant's husband went to abroad for his employment. Thereafter, the petitioner had illegal intimacy with the defacto complainant. While such being the position, the defacto complainant's husband came to India, thereafter, she stopped the relationship with the petitioner. Thereby, the petitioner went to the defacto complainant's house and attacked her and forced her to have sexual intercourse. The petitioner also threatened her that he will upload their obscene personal photographs in social media. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prayed for grant of anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.Side) appearing for the respondent would submit that investigation is pending and the petitioner's earlier bail petition was also dismissed. 5.Considering the facts and circumstances of the case and also considering the nature of allegation levelled against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
