ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 406 & 417 OF IPC, in Crime No. Not Known of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the second petitioner had sexual intercourse with the defacto complainant on false promise that he will marry her. Thereafter, refused to marry her. Hence, this complaint.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case.

4. The learned Government Advocate (Crl. Side) for the respondent police submitted that no case has been registered against the petitioner sofar. On the basis of the complaint given by the defacto complainant, enquiry was undertaken. It reveals that the petitioners demanded dowry from the defacto complainant even before conducting marriage.

5. Since no case has been registered against the petitioner, this petition has become unnecessary. If any trouble arises in the course of enquiry, the petitioner always is at liberty to workout his remedy through appropriate proceedings.

6.With the above liberty, this Criminal Original Petition is disposed of.
