PRAYER :- For Bail in Crime No.16 of 2023 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 12.01.2023 for the offences punishable under Sections 392 r/w.397, 506(ii) of IPC in Crime No.16 of 2023 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 12.01.2023 in the early morning the petitioner herein waylaid the defacto complainant and robbed a sum of Rs.200/- and also threatened with dire consequences, hence the case.
3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. He would further submit that the petitioner is in judicial custody from 12.01.2023, hence he seeks bail. https://www.mhc.tn.gov.in/judis 1/2

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner herein waylaid the defacto complainant and robbed a sum of Rs.200/- and also threatened with dire consequences and the investigation is only in the preliminary stage, hence he objected to grant bail to the petitioner. He would further submit that 8 previous cases are pending against the petitioner, out of which one case is under section 302 of IPC.
5. Heard. Perused the materials available on record including the First Information Report.
6. Taking into consideration of the facts and circumstances of the case and also the submission made by the learned Additional Public Prosecutor this Court is not inclined to grant bail to the petitioner.
7. Hence the Criminal Original Petition stands dismissed for the present.
