O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the third respondent/Tahsildar to consider the petitioner's representation dated 24.01.2026 and pass appropriate orders in accordance with law.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the fifth respondent, as no adverse orders are proposed to be passed against him.

3. The grievance of the petitioner is that, without issuing notice to the petitioner, the revenue authorities subdivided the survey number in S.No.333/1, in which the petitioner's property is comprised. Taking advantage of the erroneous subdivision and FMB sketch, the fifth respondent is attempting to claim pathway rights over the petitioner's land. Therefore, the petitioner made a representation to the second Page No. 2 of 6

respondent seeking correction of the subdivision and FMB, which is pending enquiry.

In the interregnum, the fourth respondent fixed a date for conducting the survey on 27.01.2026 based on the order of this Court dated 16.12.2025 passed in W.P.(MD) No.35907 of 2025 filed by the fifth respondent, without deciding the objections raised by the petitioner. The petitioner had already submitted a representation dated 24.01.2026 requesting the authorities to conduct an enquiry and the same is also pending. Hence, the petitioner has been constrained to file the present Writ Petition.

5. The learned Government Advocate appearing for the first to fourth respondents, on instructions, would submit that the petitioner's representation dated 24.01.2026 would be considered and appropriate orders would be passed by the third respondent within a period of twelve weeks.

6. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a Page No. 3 of 6

direction to the third respondent to consider the petitioner's representation dated 24.01.2026, conduct enquiry and pass appropriate orders on its merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The third respondent is also directed to provide a reasonable opportunity of hearing to the petitioner, the fifth respondent and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
