Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- Today, when the matter was taken up for hearing, learned Government Advocate (Crl.Side) submitted that there is no petition or complaint pending with the 3rd respondent as on today.
2. However, learned counsel for the petitioner submitted that the 1st respondent, namely, the Deputy Registrar of Co-operative Societies has given a complaint dated 16.09.2014 in NAKA/2550/2014 to the 2nd respondent, namely, The Superintendent of Police, CCIWCID, Chennai. He has also represented that the 2nd respondent has forwarded the said complaint to the 3rd respondent Police. The Investigating Officer is also present before this Court.
3. The petitioner's grievance is that if the case is closed on the premise that there is no petition pending, on one fine day, the 3rd respondent would effect arrest by registering FIR subsequently.
4. In the light of the assertion by the petitioner in the petition itself, that the 1st respondent has given a complaint in NAKA/2550/2014 dated 16.09.2014 to the 2nd respondent, making allegations against the petitioner, who is said to be an Auditor, I am closing this Criminal Original Petition with a direction to the 3rd respondent Police that in the event of they registering a case based on the complaint dated 16.09.2014 given by the 1st respondent, notice under Section 160 Cr.P.C. https://hcservices.ecourts.gov.in/hcservices/
should be issued to the petitioner and at that time, the petitioner will be at liberty to approach this Court for anticipatory bail, which ofcaurse will be decided on merits.
