Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the 3rd respondent to cancel the forged patta vide No.27 of the 6th respondent comprising in Survey No.94/26 situated at Pavali Village, Virudhunagar Taluk and District by considering the petitioner's representation dated 27.01.2026 to the first respondent which has been forwarded to the third respondent and consequently, direct the third respondent to remove the encroachment made by the sixth respondent within the stipulated period as fixed by this Court.

ORDER
(Order of the Court was made by DR.G.JAYACHANDRAN, J.) This Public Interest Litigation is filed by one R.Sekar seeking 2/6
mandamus to direct the third respondent/Revenue Divisional Officer to cancel the patta No.27 issued in favour of the sixth respondent in respect of survey No.94/26, Pavali Village, Virudhunagar Taluk, alleging that the patta was issued based on forged document and to consider the representation of the petitioner dated 12.01.2026 given to the District Collector/first respondent, which has been forwarded to the Revenue Divisional Officer/third respondent for consideration within stipulated period.
2. A perusal of the records and the pleading indicates that being aggrieved by the issuance of patta in favour of the sixth respondent, the petitioner herein has given a Monday petition to the District Collector on 12.01.2026. Thereafter, he has given a representation directly to the third respondent/Revenue Divisional Officer on 27.01.2026. On the very same day, he has filed this writ petition seeking mandamus.
3. The way, in which the petitioner has approached this Court is deprecated. The Public Interest Litigation cannot be filed in such a cavalier manner seeking mandamus by filing a writ petition on 3/6
27.01.2026 to pass order on the representation dated 27.01.2026. The persons like petitioner do not abuse the Public Interest Litigation jurisdiction.
4. For this sole reason, this Writ Petition stands dismissed. To prevent such writ petition filed in the garb of Public Interest Litigation, we impose a cost of Rs.2,000/- (Rupees Two Thousand only) payable to the High Court Legal Services Committee attached to this Bench within a period of two weeks from today (05.02.2026).
