ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.5, in Crime No.243 of 2015 on the file of the respondent police, was arrested on 31.07.2015 for the alleged offences punishable under Section 174 Cr.P.C., altered to 302 I.P.C., and altered under Sections 120(b), 201, 302, 364(A) r/w. 34 of I.P.C., and hence, seeks bail.

2. According to the prosecution that the deceased, who is the wife of the third accused was having illicit relationship with so many accused and therefore, on 27.07.2015, the third accused with the help of the other accused take her in a car and strangulated her with saree and thereby she was done to death.

3. The learned counsel for the petitioner submitted that the petitioner is a lady and even as per the confession of the co-accused, she caught-hold of the deceased, when the deceased was strangulated by the first accused. The learned counsel for the petitioner further submitted that she has been in incarceration for more than 78 days and that the fourth accused was already granted bail by the Sessions Court in Cr.M.P.No.2130 of 2015 on 02.09.2015.

4. The learned Government Advocate (Crl.side) submitted that all the accused in this case was arrested on 27.07.2015 and major part of the investigation is over.

5. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned https://hcservices.ecourts.gov.in/hcservices/

Judicial Magistrate, Nilakottai and on further condition that the petitioner shall report before the respondent police daily at 10.00 a.m. until further orders.
