PRAYER : Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondent to refund the caution deposit amount of Rs.4,00,000/- (Rupees Four Lakhs only) for the 1/4

collection of the vegetable and fruit market fee under the fourth respondent in light of the orders passed in W.P.(MD)No.19596 of 2020 dated 02.01.2021. 2.Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents 1 to 3 and the learned standing counsel for the fourth respondent.

3.The learned standing counsel appearing on behalf of the fourth respondent, namely the Municipality, submitted that the representation made by the petitioner has been considered and that orders will be passed and conveyed to the petitioner.

4.Taking into consideration the facts and circumstances of the case and the limited relief sought for by the petitioner in this writ petition, there shall be a direction to the fourth respondent to deal with the representation made by the petitioner on its own merits and in accordance with law and after taking into consideration the Government Order in G.O.(D)No.337, Municipal Administration and Water Supply (MA.IV) Department, dated 16.06.2023 and convey the d ecision to the petitioner within a period of four weeks from the date of receipt of a copy of this order.

5.This writ petition is disposed of with the above direction. No costs.
