PRAYER : Transfer Civil Miscellaneous Petition is filed under Section 24 of Code of Civil Procedure, to withdraw the H.M.O.P.No.1257 of 2022 on the file of the Family Court, Madurai filed by the respondent and transfer the same to any other court in Pudukottai District. ORDER

The present transfer civil miscellaneous petition has been filed by the wife seeking to transfer H.M.O.P.No.1257 of 2022 pending on the 1/4

file of the Family Court, Madurai to any other court in Pudukottai District.

2. According to the learned counsel appearing for the petitioner/wife, the wife is residing at Viralimalai along with her parents and she is having 2 minor children. She finds it difficult to travel on every occasion to attend hearings in Family Court, Madurai.

3. The learned counsel appearing for the respondent/husband contended that the husband is working as a Private Security in Tiruppur. He may find it difficult to appear for every hearing in any Court in Pudukkottai.

4. Considering the above said facts, H.M.O.P.No.1257 of 2022 pending on the file of the Family Court, Madurai is hereby withdrawn and transferred to Principal Sub Court, Pudukkottai. The learned Subordinate Judge is directed to dispose of the same as expeditiously as possible.

5. With the above said direction, this Transfer Civil Miscellaneous Petition stands allowed. No costs. Consequently, connected Civil Miscellaneous Petition is closed.
