Criminal Original Petition filed under Section 482 of Cr.P.C. to direct the learned Sub Court, Mudhukulathur, Ramanathapuram District to expedite the criminal trial proceedings in S. C. No. 111 of 2018 within a stipulated time as fixed by this Honourable Court. ORDER:- This Petition coming on for orders on this day and upon perusing the earlier order of this Court dated 04/02/2022 and the requisition letter in D.No.1573/2022, dated 27/09/2022 submitted by the Subordinate Judge, Mudukulathur, Ramanathapuram District, this Court made the following order:

The learned Assistant Subordinate Judge, Mudukulathur, Ramanathapuram District had offered her remarks.

2. This Court by an order dated 04.02.2022 in Crl.O.P(MD) No.2390 of had directed the learned Assistant Sessions Judge, Mudukulathur, Ramanathapuram District to dispose of the case in S.C.No.111 of 2018 within a reasonable period of six months. As per her remarks, L.W.1 to 4 belongs to same family and their whereabouts is not known. The Inspector of Police, Kamuthi Police Station, Ramanthapuram District had furnished certificate that the whereabouts of L.W.1 to 4 are not known issued by the Village Administrative Officer. Paper publication is also effected. Since the whereabouts of L.W.1 to L.W.4 are not known, the prosecution had examined other witnesses. Summons were issued to L.W.5 to 13. L.W.8,9,10 were examined as P.W.1,2 and 3 and they turned hostile. Only the rest of the witnesses are to be examined.

3. In the light of the remarks offered by the learned Assistant Sessions Judge, Mudukulathur, Ramanathapuram District is directed to dispose of the case in S.C.No.111 of 2018 within the extended https://www.mhc.tn.gov.in/judis 1/2

period of three months from the date of receipt of a copy of this order.

4. The prosecution is directed to produce the entire remaining witnesses on the same day to enable the learned Assistant Seesions Judge, Mudukulathur, Ramanathapuram District to dispose the case within a month from the date of receipt of a copy of this order.
