ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody since 09.03.2019 for the offences punishable under Sections 174 Cr.P.C @ 306 of IPC in Crime No. 33 of 2019 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner had illegal intimacy with the defacto complainant's wife and eloped with him and thereafter the defacto complainant gave a complaint before the respondent police and she was secured. Whileso on 09.03.2019, when the defacto complainant questioned questioned his wife about her illegal relationship, the deceased consumed poison and committed suicide. Hence the complaint.
3.The learned for the petitioner would submit that the petitioner is an innocent person and he has committed any offence as alleged by the prosecution. He would also submit that the petitioner is in judicial custody for morethan 60 days. 4.Mrs.S.Bharathai, learned Government Advocate(Crl.Side) takes notice for the respondent. She would also submit that investigation is pending and objected for grant of bail.

5.Considering the facts and circumstances of the case and considering the period of incarceration, this Court is inclined to grant bail to the petitioner with stringent conditions. 6.Accordingly, it is ordered that the petitioner shall be released on bail, on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a likesum to the satisfaction of the learned Judicial Magistrate, Papanasam, Thanjavur District and on further condition that the petitioner shall appear before the learned Judicial Magistrate, Papanasam, Thanjavur District daily at 10.30 a.m and 5.00 p.m until further orders.
