O R D E R
Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondents 1 to 3. Considering the nature of relief to be granted, issuance of notice to the fourth and fifth respondents are dispensed with.
2.The petitioner belongs to Yadhava Community. She had already attained majority. She fell in love with a boy belonging to Scheduled Caste Community. She got married to him also. Since it is 1/3
an intercaste marriage, the fourth and fifth respondents, who are parents of the petitioner are opposed to it. The petitioner apprehends life threat at the hands of her own parents. 3.The learned Government Advocate (Crl. side) submitted that since a criminal case has been registered at the instance of the petitioner's parents, it can be given a closure only after recording the statement of the petitioner.
4.The petitioner's counsel states that the petitioner will appear before the Office of the Public Prosecutor at the Madurai Bench of Madras High Court. The date and time will be finalized between the counsel for the petitioner and the learned Government Advocate (Crl. side). After recording the petitioner's statement, the third respondent is directed to close the FIR also. 5.The closure report will also be duly accepted by the learned Jurisdictional Magistrate. Since the apprehension expressed by the petitioner cannot be disregarded, the third respondent is directed to summon the parents of the petitioner and take statement from them that they will not interfere with the marital life of the petitioner herein. Whatever the steps there are neccessary to ensure the physical safety of the peitioner will also be done by the third respondent.
6.This Criminal Original Petition is allowed on these terms.
