PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records of impugned order passed by Respondent No.2 vide his proceedings R.C.no.4750294/AP II (3) 2023 dated 14.06.2023 and quash the same as illegal, arbitrary and consequently direct the Respondent No.3 to reinstate petitioner with all consequential benefits of backpay, continuity of service, seniority, promotion.

O R D E R

The petitioner, who is working as Grade II police constable at Theni Police Station has been terminated from service on compulsory retirement, by the order impugned in this writ petition.

2.Today(30.01.2026), when this writ petition is taken up for hearing, the learned Additional Government Pleader appearing for the respondents submits that this petitioner has already filed a 2/5

Review application as against the order of the Disciplinary authority and the Appellate Authority before the Secretary to Government, Home Department/the first respondent herein, on 04.04.2025 and the same is pending. While so, the petitioner has preferred this writ petition.

3.Since it is reported that this petitioner has already invoked the appeal remedy, which is available to this petitioner and the same is pending before the first respondent, this writ petition is disposed of, with a direction to the first respondent to dispose of the review application filed by this petitioner on 04.04.2025, within a period of four months from the date of receipt of a copy of this order. No costs. Consequently, connected Miscellaneous petition is closed.
